A Chili Omelette and Law 101

Good morning breakfastpoppers. Today is Wednesday, July 7, 2010. I am pleased to announce that we have been invited to attend a class at the local law school this morning. The focus of the class will be on Arizona's anti-illegal immigration law, so I imagine it should be quite interesting. Let's prepare a Chili Omelette and head for class. You will need 3 eggs, 1 teaspoon butter, 1/2 teaspoon cumin, a dash of salt and pepper, 1 teaspoon diced red pepper, 1/2 cup grated sharp cheddar cheese and 1/2 cup of chili. In a small bowl, beat eggs, seasoning and peppers. Melt butter in a pan and add egg mixture. Cover with lid and allow eggs to set. Flip the omelette over and spread the chili on top. Sprinkle the cheese, fold the omelette in half and cover pan once again. When cheese melts, remove from pan, slice in half, place omelette in your lunchbox, fill your thermos with something interesting and head for class. See you in a few.
Good morning and welcome to a class which I like to refer to as Law on the Fly. Yesterday the Department of Justice filed a lawsuit challenging Arizona's immigration policy. The federal government is claiming that the Arizona law is invalid and that it interferes with federal immigration responsibilities and therefore must be struck down. Now let's take a moment and analyze the government's position, which is to say the least "awkward". The federal government has virtually the same law on the books, does it not? And does the federal government enforce the law as written? No, it does not. The government states that the Arizona law interferes with federal immigration responsibilities. Has anyone in this room seen any evidence whatsoever of the government taking responsibility for this growing problem? I don't see any hands raised, because quite simply, the government has ignored the problem and placed the people of Arizona in jeopardy.
The basis for the federal government's lawsuit is the Supremacy Clause which states that federal law trumps state law. I don't see the foundation of this suit holding up in court because, as we discussed, the Arizona law mimics the federal law. The Supremacy Clause only comes into the equation when a state law is contrary to a federal law or the Constitution. It looks like somebody at the Department of Justice forgot to do their homework. Five federal appeals courts have already taken up this issue and have upheld the state's rights to arrest illegals. I guess the term"illegal" still resonates in some areas of our society. The government will no doubt also argue that the Arizona law opens the way to racial profiling, which is yet another example of the Department of Justice not doing their job. The Arizona law prohibits racial profiling, a fact that does not seem to penetrate the brains of this administration or some other states who have turned against Arizona in its attempt to protect its citizens.
There is a memo in existence at the Department of Justice from 2002 that concludes that the state police have "inherent power" to arrest undocumented immigrants for violating federal law. I have no doubt that this memo will surface during the proceedings providing it doesn't find its way to a shredder first.
We are running out of time this morning, so let me conclude today's class with two thoughts to ponder. One is that according to the Federation for American Immigration Reform, the cost of harboring illegal immigrants in the United States is an unbelievable 113 billion dollars a year. Can we really afford to keep this dangerous charade going? No, of course we can't. My second point is one that states who have turned against Arizona should consider. I suggest that you welcome all illegal aliens to your door. Have buses at the border. Help the illegals cross over, put them on the buses, provide them with a box lunch, the promise of employment, medical care and a life of undocumented bliss. When your costs start to mushroom and crime is on the rise don't even consider turning to Arizona for help. I suggest that you suffer in silence...POP...

POP: I believe the key word in your class, professor POP, is "responsibilities". the Federal government is making a fool of itself, and doesn't get it. Let's see...The Feds are upset that Arizona has passed the same law that they (feds) have a responsibility through the Supremacy Clause to enforce.

Any good judge would through this court case out - but wait - the judges are appointed - so this rediculous law suit will have to see it way through the system.

You nailed that one. It will be very interesting to see how this shakes out. If the feds prevail there will be no such thing as lawful immigration here. Every Mexican will feel entitled to jump over the fence and obtain employment, free medical care and free educaiont for their children. I think that Arizona should send a monthly bill to the white house for all of the costs they incur with respect to illegal immigration from Mexico. If the feds won't enforce their own law, then Arizona should enforce its law and bill the feds for not doing so. And if the feds win, probably a lot of terrorists will be hiding with the Mexicans and jump over the wall. And to Tom, Obumma and all his cronies are trying to make the USA into the United Socialist States of America. Morning POP...Enlightening class this morning...Imagine suing Arizona for reiterating federal law but not suing sanctuary cities for defying federal law...the DOJ has it backwards !! Political correctness now shapes how our laws are to be interpreted...as if political correctness is the prism we must look through before enforcement of settled law...

It worries about the quick descent this could send America down - dividing the states and the people. I can't help everything this administration does is a some diversionary tactic. Is it just me?

Pop, first off I don't drink no stinking Mescal tequilla, I drink home brewed 200 proof white lightening with baby rattle snakes in the bottle, it makes me mad dog mean! Arizona has several laws that mimic federal law off the top of my head, how about brewing white lightening, making full automatic fire arms, silencers for said firearms, and I could go on, but why? If the court rules against us, we should then remove all laws that hold hands with the federal laws as I would guess the precedence would be set and what the hell let us get out of step with them all together! Where the hells Texas and California as they share in the problem as well, three states would be better than one. Hence this day it begins! Every one begin bombarding Gov. Jan Brewer on face book and her office with letters of support as well as demands to drop all federal laws mimicked by Arizona and making them legal, guns, bombs, marijuana, stills and the like, a state sponsored gun range at every major border crossing with barrels pointed south and refuse even the smallest of investigation in accidental deaths from those who would cross illegally there, all just another accident, oops! another one right in the forehead! Excellent piece of writing. My husband, who watches Fox news as much as I, has even been fooled by the administration liars. He thinks the law allows profiling as well. when I explained the truth, he was confused and said I had to be wrong. I simply reminded him again that it is pretty clear now that BO doesn't let a little lie slow him down!!
Can anyone name one thing he's done FOR America, rather than against us? I can't think of one.
This issue really makes my blood boil! The fact that there are states who are trying to boycott Arizona is ridiculous. I really hope Arizon is successful with what they are doing and other states will follow suit. I thought I read somewhere there is a city in Nebraska that is trying to do the same thing. We need to get a handle on this illegal alien situation before it's too late.

First off I have been absent for the past few weeks; I felt the need to re-enter the working world at least on a limited basis so I signed on with a group of pirates raiding off the east coast; they pay me in gold bullion which I bury in my back yard. This current regime has me so concerned I’m preparing for the arrival of the Redistribution Police which are coming soon to a neighborhood near you. But moving right along!
Correcto-Mundo; Arizona's immigration policy does indeed interfere with federal immigration responsibilities of this regime. The Arizona Law is based on enforcement while the current regime’s interpretation is based on Laissez Faire!
This Regime is Ruling as opposed to governing based on the Supremacy Clause; what they say trumps federal and state law; even the Constitution!

Pop my conclusion is the real cost of harboring illegal immigrants in the United States is 4 more years of the Obama Regime which we really can’t afford!
Ok I have an idea. Lets take Mexico, make it part of America, open the borders, tax the hell out of our new citizens, and enjoy our newfound oil resources and beach front property.

Two things BPop.It should be obvious to anyone that our AG is a blatant racist who would love nothing more then seeing this country go down in flames. The law in Arizona was not just some kneejerk reaction , this law was carefully crafted to make sure that it stood up in court.And you combine that with a very antagonistic mood that is growing towards this administration and I believe the law will stand. These guys are only favored by a myopic and deluded minority that we call liberals.

I used to support Mexicans to enter the country by whatever means because I have traveled extensively through Mexico and see how poor they are.
That is no longer the case. I have seen Texas become something foreign to me. Santa Ana may have lost the war, but the people of Mexico and South America have started a new war of invasion. Apparently, Texans have forgotten to "Remember the Alamo".
I don't understand why we are still fighting in Afghanistan and Iraq when we do have a real war along our southern border. Why is everyone ignoring this (except Arizona)?
Governor Perry has made some tiny effort to support Arizona and has proposed a similar law to go on the books for Texas. But unless we support him on this, I fear it will fall by the wayside. So please send emails to the governor's of ALL the border states!
